These conditions shall apply to all online transactions between Highland Fayre Limited ("Highland Fayre") and any person, firm or company ("the Purchaser") placing an order online with Highland Fayre for the manufacture and/or supply of any goods ("the Goods"). Highland Fayre by accepting any order for Goods from the Purchaser agrees to sell and the Purchaser agrees to purchase such Goods at the price stated on Highland Fayre's website and on the sole basis of the terms and conditions of Highland Fayre stated herein.
Prices for Goods include Highland Fayre's standard packaging, VAT (VAT No: 400 7399 70) and postage or carriage.
2. SECURE ONLINE PAYMENT
Highland Fayre provides a secure payment system by utilising the services of PayPoint.net for all online payments. Payments can be submitted online using protocol 128 bit SSL (Secure Socket Layer), the strongest commercially available level of encryption. The private data of the Purchaser will be encrypted at all times whilst in transit over the Internet. The Purchaser should see a solid padlock in their browser status bar which indicates that the encryption is taking place. Credit card payments can be made using Visa, Mastercard, Visa Debit, Maestro, Laser, Visa Electron, JCB, American Express, Switch and Solo. Goods will only be despatched once payment has been received in full.
3. RETENTION OF TITLE
Property in the Goods shall not pass until the full amount has been paid.
Highland Fayre will make every effort to despatch orders within 5 working days of receipt. The standard prices listed on the website include a Next Day delivery service within the UK mainland (Monday to Friday only) excluding December. Delivery to the Scottish Highlands and outside the UK mainland will be between 2-5 days, depending upon the destination. The carrier will attempt delivery and if the recipient is not at home the carrier will leave a card to say they attempted delivery. On occasions, the carrier may leave the delivery with a neighbour where it can be signed for. The carrier will re-attempt delivery twice more leaving a card each time if the recipient is not home. It is then the recipient's responsibilty to contact the depot and arrange for collection. If you wish the carrier to re-attempt delivery beyond these attempts a surcharge of £8.22 will be deducted from the Purchaser's credit card. If there has been no response within 3 working days, Highland Fayre will be notified by the carrier of the situation. If Highland Fayre is unable to rectify the problem, having tried to make contact with the Purchaser, then the Goods will be returned to Highland Fayre. Thereafter, the Purchaser will incur a re-delivery charge to deliver the Goods again at twice the original cost (since Highland Fayre will have incurred a return charge by the carrier). The Purchaser will also be charged for any items which have become unsuitable for sale and need replaced (mainly perishable items like smoked salmon and cheese which have short shelf lives). The Purchaser can contact Highland Fayre for an upgraded UK delivery service, (i.e Saturdays) excluding December. The extra charges will be quoted on request. Orders for Christmas must be received by Highland Fayre NO LATER than the last Monday in November. Whilst every effort is made to deliver orders on the requested day, during the run up to Christmas, we will deliver as close to the requested date as possible. However, please allow additional time for volume of traffic and adverse weather conditions.
The Purchaser can cancel an order prior to despatch or within 7 working days of receipt of Goods by Telephone +44 (0)1738 639222, Fax +44 (0)1738 621177 or Email Sales@HighlandFayre.co.uk , stating the "Order Acknowledgement" reference number which is automatically emailed to the Purchaser on receipt of the online order by Highland Fayre. The Purchaser's credit card will be refunded by Highland Fayre for the full amount within 2 working days if the Goods have not been despatched. If, within 7 working days of receipt of Goods, the Purchaser wishes to cancel the contract, the Goods must be returned to Highland Fayre Ltd, Ruthvenfield Grove, Inveralmond Industrial Estate, Perth, PH1 3FN, suitably packaged, the Purchaser's credit card will be refunded by Highland Fayre for the full amount within 30 working days.
6. COMPLAINTS/CUSTOMER SERVICE
The Purchaser should inform Highland Fayre immediately of any problems by Telephone +44 (0)1738 639222, Fax +44 (0)1738 621177 or Email Sales@HighlandFayre.co.uk . Complaints are taken very seriously by Highland Fayre and will be dealt with within 5 working days, although most complaints can be corrected within a few hours. Please note that the Purchaser is also welcome to contact Highland Fayre on any issue relating to their order on the contact telephone, fax or email listed above. Highland Fayre's operating hours are from 09:00 GMT to 17:00 GMT, Monday to Friday.
7. DAMAGED GOODS
If the Goods are damaged, the Purchaser should contact Highland Fayre within 3 days of receipt of Goods. Damaged Goods must be returned to Highland Fayre Ltd, Ruthvenfield Grove, Inveralmond Industrial Estate, Perth, PH1 3FN, suitably packaged. Highland Fayre will replace or refund the items concerned and refund the return postage costs. If your order appears to be damaged upon arrival, it is advisable to refuse the delivery and contact Highland Fayre immediately to arrange for a replacement.
Highland Fayre reserves the right to substitute items of similar or greater value, if for any reason those listed on the web site are unavailable. If you decide not to accept the substituted goods, we will pay for their return.
By placing an order and agreeing to our terms and conditions the Purchaser declares that they are of the appropriate legal age to purchase the Goods. Items containing alcohol can only be ordered by and delivered to those aged 18 or over and must not be purchased for onward supply to persons under 18. If Highland Fayre discovers that the Purchaser is not legally entitled to order certain Goods, Highland Fayre shall be entitled to cancel the order immediately, without notice.
Liability insurance is automatically included by Highland Fayre on all Goods ordered.
11. FORCE MAJEURE
Highland Fayre will exercise every reasonable effort to meet the requested despatch date. Highland Fayre shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to securing necessary export licences, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.
12. ONLINE PRESENCE
No warranty is given by Highland Fayre that their website will be constantly online or free of defects and errors at any time.
13. SECURITY ONLINE
Highland Fayre accepts credit card payments online from Visa, Mastercard, Maestro, American Express, Eurocard, Delta and Solo. Transactions conducted at our web site are protected by the strongest commercially available 128-bit encryption technology, used worldwide. Look out for the padlock symbol at the bottom of your screen whenever you are asked to submit payment details.
